THE LAB [CUSTOM DYE PROGRAM] TERMS & CONDITIONS
These are the Terms and Conditions between labdip Inc. (Seller) and the holder of the wholesale account (Buyer), including their agents acting on their behalf. These Terms and Conditions supersede Buyer Purchase Orders.
RESELLING BLANKS
labdip Inc. garments are not to be resold as blank goods unless previously approved by Seller in writing. Buyer agrees to customize blank garments by printing, embroidering or otherwise embellishing the outside of the goods prior to selling. A label change is not sufficient modification. Anyone found to be reselling blank merchandise without labdip Inc.’s authorization will have their wholesale privileges permanently revoked.
RETURNS
All sales of custom dye goods are final. Seller does not accept returns or exchanges.
IMPERFECTIONS AND DAMAGES
Once the Buyer's custom dye order has been shipped, it is the Buyer's responsibility to do another quality control check. This is also the case if the Buyer is sending their custom dyed goods to a print shop, finisher, etc. Any claims of defect must be brought to Seller’s attention in writing via email to wholesale@labdip.la within 5 calendar days of delivery receipt. Buyer agrees that a 5 day period is a "reasonable" period of time to make such claims, and further agrees to inspect all merchandise within that time. Any rights to reject or return merchandise expires after this 5 day period.
FINAL SALE
Customized goods are final sale, except in the case of manufacturer imperfections or damages. See IMPERFECTIONS AND DAMAGES above.
ESTIMATED DELIVERY DATE
labdip Inc. will always try to ship as quickly as possible, but manufacturing of garments is a human process with many moving parts. While a shipping estimate is provided at the time of your order being placed, there may be delays due to unforeseen circumstances. In this case, Seller will notify Buyer as soon as possible, however if a custom order is already in process, it may not be cancelled. If Buyer has a very specific delivery deadline, Buyer may be required to pay expedited shipping or rush production fees.
OVER/UNDER POLICY FOR GARMENT DYE
When producing custom dyed garments, labdip Inc. manufactures an additional 5-10% in case of fallout in the dye process. In some cases, there is no fallout and there will be additional units, with up to 10% being added to Buyer’s final invoice. Imperfections will be offered to Buyer at a 30% discount. If Buyer chooses not to purchase the imperfections, they will be sold with no mention of Buyer or their brands. If there is more than usual fallout in a particular size, Seller will make up missing units with another size, or as a last result, may short ship. If Buyer requires specific units, ordering a few extra units per size is recommended.
COLOR PRODUCTION SAMPLE
If dyeing to a custom color, Buyer is required to run a production sample to match a Pantone shade. This is a swatch of fabric or a garment that is test dyed to hit your color standard. The cost of this is $85 per color and fabric.
